Indian Bayh Dole: Is it
Relevant or Negligent?

Abstract
The Bayh Dole Act 1980 is an existing regulation in USA
which deals with the management of intellectual property
of public funded projects. There were positive outcomes
fallowing the enactment leading to spurt in registration
of patent out of public funded projects in USA. In India
also the scientific research in academia and research
organizations the major fund givers are central and
state Government agencies like DST, DBT, CSIR, AICTE and
UGC. The Government of India in order to foster patent
filling out of public funded projects introduced the
Protection and Utilization of Public Funded Intellectual
Property Bill 2008” in the month of January 2009 in
Rajya Sabha. There is lot of debate happening among
stakeholders regarding the impact of the bill on patent
management of public funded projects. A summary of
discussions is presented in this article.
