Drug Price Control Mechanisms in The Indian Patent System

Introduction: The Indian economy was and continues to remain generic-oriented, a major concern being unaffordability of essential medicines. The Indian patent system balances provisions made towards innovators and generics, with many provisions primarily focusing on drug price control. The article analyses some of the provisions of the Indian Patent Act that directly or indirectly attempt to control drug pricing such as Section 3(d) preventing evergreening by innovators, compulsory licensing and Bolar provisions.
